Mantatory information to the Consumer of the Credit Intermediary

(Legal framework of credit intermediaries, Articles 53 and 54 of Decree-Law No. 81-C/2017 of July 7)

Banco ActivoBank, S.A.

It is registered at Conservatória do Registo Comercial of Lisbon, with a share capital of 127.600.000,00 Euros, single registration and corporate entity number 500 743 305 and head office at Rua Augusta, 84, Parish of Santa Maria Maior, 1149-023 Lisbon. It is registered at Banco de Portugal as a tied credit intermediary, qualified to intermediate contracts of Home Loan, information that can be read on the Website of Banco de Portugal: www.bportugal.pt

Banco ActivoBank, S.A. has entered into a binding agreement with the credit lender, Banco Comercial Português, S.A., and carries out credit intermediation activities on an exclusive basis.

Banco ActivoBank, S.A. has taken out a professional liability insurance policy with Ocidental Seguros (policy no. RC78570881, valid for a renewable one-year period).

Banco ActivoBank, S.A. does not provide consulting services for credit contracting.

The intermediation services provided in the exercise of its credit intermediary activity are as follows:

  • Presentation or proposal of credit agreements to consumers;
  • Assistance to consumers by carrying out preparatory acts or other pre-contractual management acts in relation to credit agreements that have not been presented or proposed by the consumer.

As a tied credit intermediary, Banco ActivoBank, S.A. is prohibited from receiving or delivering any amounts from consumers related to the formation, execution, or early repayment of credit agreements. The Bank is solely remunerated by the credit lender, in accordance with Article 46(1).

Banco ActivoBank, S.A.'s activity as a credit intermediary is subject to the supervision of the Banco de Portugal.

Pursuant to Article 54(1)(e), the credit intermediary informs that its remuneration is determined by the services provided. Banco ActivoBank, S.A. receives from Banco Comercial Português, S.A. a commission corresponding to 64% of the net present value of the margin of each Home Loan transaction, with net present value understood as the adjustment of financial flows of the debt service of each loan.

Complaint and Alternative Dispute Resolution Procedures

In the event that Clients wish to lodge a complaint about the intermediation activity, it is possible to do so in person at any ActivoBank Branch, in writing to the head office,  through the App via Apoio AB, or by calling 210 030 700 (from Portugal or abroad), with personalized service available on business days (8am to 10pm), Saturdays (10am to 8pm), Sundays and public holidays (12pm to 8pm), the cost of communications depends on the tariff agreed with your telecommunications operator, and/or written, in which case the complaint should be sent to Avenida Doutor Mário Soares, (Tagus Park Building 10) 2744-005 Porto Salvo.

A complaint may also be submitted by filling out the Complaint Book form(s) available at the Activo Branch, without prejudice to the possibility of filing a complaint directly with Banco de Portugal. To do so, the online complaint form available on the Portal do Cliente Bancário (Banking Customer Portal) must be completed. Alternatively, the complaint form may be printed, filled out, and sent by mail to Banco de Portugal at the following address: Apartado 2240, 1106-001 Lisbon.

Without prejudice to access to the competent judicial means, the Client may also submit complaints and disputes arising from credit intermediation activities to the following out-of-court dispute resolution entities to which the Bank is affiliated: the Centro de Arbitragem de Conflitos de Consumo de Lisboa (Lisbon Consumer Conflict Arbitration Centre), located at Rua dos Douradores, no. 108, 2nd and 3rd floors, in Lisbon (www.centroarbitragemlisboa.pt) and the Centro de Informação de Consumo e Arbitragem do Porto (Porto Consumer Information and Arbitration Centre), located at Rua Damião de Góis, 31 – Loja 6 – 4050-225 Porto (www.cicap.pt)
